Past Verdicts and Settlements in Motorcycle and Bicycle Cases

  • $2,494,000.00 VERDICT, jury trial, $100,000.00 SETTLEMENT, Martin V. Cal-Trans, Marin County Superior Court. Defendant: State of California, Department of Transportation. Plaintiff Martin, a 26 year old motorcyclist on a GSXR 750 motorcycle, suffered paralysis of right arm and facial injuries following auto vs. motorcycle collision in Marin County, near the town of Bolinas. The accident was due to dangerous condition of public property, namely vegetation that had grown so as to block view of the cross traffic. The pre-trial offer of $30,000.00 was rejected. The police report attributed 100% of fault to motorcyclist, but the jury found that motorcyclist was not liable for his injuries. Trial Lawyer: Christopher B. Dolan.
  • $1,750,000.00, SETTLEMENT Motorcycle accident at 25th and Church when a San Francisco motorcyclist drove through stop sign that driver could not see because of overgrown vegetation. The motorist had his leg amputated below the knee. The negligent motorist paid $1,250,000.00 and the building owner paid $500,000.00 for failing to maintain his tree.   • $1,650,000.00 SETTLEMENT, Goldthwaite v. County of Lake. A fifty four year old motorcyclist was injured in single motor vehicle accident in Lake County when his Ducatti 998 lost traction because of a dangerous condition of public property, a roadway defect of loose gravel. The motorcyclist hit a guardrail, causing crush fracture of the 11th thoracic vertebrae and nerve damage. The police report attributed 100% of the fault to the motorcyclist.   • $976,141.00 VERDICT, jury trial. The Dolan law firm atorneys Christopher B. Dolan and Rachel Pusey obtained a verdict in the amount of $976,141.00 at trial for a husband and wife in San Francisco, California. The case involved a collision between an eighteen-wheel tractor trailer and a motorcycle operated by Plaintiff. The operator of the trailer, after double parking his tractor trailer rig, with an end dump trailer loaded with dirt, backed his truck up Brannan Street towards Second Street. The driver backed into Plaintiff who, intending to turn right on Jack London Street, had approached from behind on his motorcycle. Plaintiff suffered a fractured tibia that required several operations. The driver of the trailer and the company that employed him denied that the collision caused all of the injuries that are claimed by the husband as well as the nature and extent of the injuries that he suffered in the collision. The marital relationship suffered as a result of the incident and the wife sued for loss of consortium. Her damages were disputed by the Defendants as well. Following a three week trial, the jury returned a total verdict of $976,141.00 in favor of Plaintiffs.
  • $900,000.00 SETTLEMENT in wrongful death of a 28 year old, a close friend of Christopher Dolan, when he was killed in a vehicle crossover collision in Arizona. Trial Lawyer: Christopher B. Dolan. Names confidential as condition of settlement.
  • $500,000.00 SETTLEMENT, wrongful death of motorcyclist in Napa County as a result of a car pulling back onto roadway from the shoulder, causing another car to cross the center-line into the motorcyclist.   • $365,000 VERDICT, judge trial Baecht v. Elwir, San Francisco Superior Court. A bicyclist was injured when a passenger opened a car door directly into his path, causing spleen removal. Trial Lawyer: Christopher B. Dolan.
  • $320,000 SETTLEMENT, medical negligence, There was a failure to diagnose a hip fracture following a motorcycle accident, leading to a hip replacement in 32 year old man.   • $238,000.00 VERDICT, jury trial, bike accident case, Chambers v. Gorden, San Francisco Superior Court. A bicyclist was traveling on Lincoln Blvd. in the Presidio when a pedestrian stepped out in front of a parked car, causing a fractured jaw and cheek for the bicyclist and fractured cheek of the pedestrian. The pedestrian countersued the bicyclist as being at fault. An offer of $175,000.00 came from the pedestrian, with a demand of $15,000.00 for his own injuries.   • $113,000.00 VERDICT, jury trial, Wanvig v. CCSF MUNI, San Francisco Superior Court. MUNI bus passenger injured falling on plastic bag on steps of buss that had not been cleaned. Zero offer from defendants. Trial Lawyer: Christopher B. Dolan.
  • $103,900.00 VERDICT, jury trial, Cho v. U.C. Berkley, Alameda County Superior Court. Bicycle Accident. A bicycle rider was hit on UC Berkeley Campus by an electric maintenance cart, causing laceration to the lower leg, scarring, and loss of sensation to the small toe. Offer: $10,000.00.   • $100,000.00 SETTLEMENT, Personal Injury. An elderly woman was injured while riding a San Francisco Muni bus. To avoid a collision with a Honda making a right turn as the bus was leaving a scheduled stop, the bus driver slammed his brakes suddenly. This caused the plaintiff to be thrown off her seat, hitting the seat in front of her, and landing on the bus floor. The plaintiff was taken to the hospital by emergency personnel. As a result of this accident, the plaintiff, once a fairly healthy 70-year old woman, developed knee, shoulder, and back problems and also headaches. According to investigation, the bus driver acted in a careless manner for a public transportation driver who is responsible for the safety of passengers. The Honda driver did not expect bus driver to move forward, blocking his turn, since the bus was stopped at a bus stop. Case was settled for $100,000.00 in favor of Plaintiff, including attorneys' fees.
